FY26 National Defense Authorization Act Does Not Include CIG Housing Provision

Congressional leaders released the final, joint House and Senate text for S. 1071, the National Defense Authorization Act for Fiscal Year 2026 (NDAA) Dec. 8. The House and Senate are expected to pass the NDAA before the end of the year.
The released text does not contain S. 2363, the Build More Housing Near Transit Act of 2025, which had been included in the Senate-passed NDAA. S. 2363, introduced by sens. Brian Schatz (D-HI) and Jim Banks (R-IN), amends the ratings process for New Start and Core Capacity projects seeking funding through the Capital Investment Grants (CIG) program. Specifically, the bill allows for a positive adjustment for the project justification rating if the project sponsor submits documented evidence of pro-housing policies.
