THUD Appropriations Bill: Immigration Enforcement Provision and CIG Project Funding

H.R. 9170—the Transportation, Housing, and Urban Development, and Related Agencies Appropriations Act, 2027 (THUD Appropriations bill)—as approved by the House Committee on Appropriations, significantly cuts public transit and passenger rail funding, compared to FY26 enacted levels. As reported previously in Passenger Transport, there is a 22 percent reduction for public transit and a net loss (-112 percent reduction) for passenger and freight rail.
The bill now includes policy provisions regarding immigration enforcement. Specifically, section 424 of the bill prohibits USDOT from providing grants or loans to a local jurisdiction that refuses to comply with a request from the Department of Homeland Security “to provide advance notice of the scheduled release date and time for a particular illegal alien in local custody.”
Under Capital Investment Grants (CIG), the bill designates CIG funding for 18 projects—seven New Start and 11 Small Start—which are detailed in the Committee Report (p. 67-68) that accompanies the bill. The legislation requires FTA to make allocations to the designated projects within 120 days of the date of enactment of the THUD Appropriations Act. FTA may not deviate from the listed funding amount for each project by more than 10 percent. The House THUD Appropriations bill provides the lowest CIG funding in more than 35 years.
